Front Garden Competition – Terms and Conditions
In these terms and conditions:
“Balcon” means Balcon Group Pty Ltd ACN 141 776 150.
“Competition” means Orana’s Annual Front Garden Competition, the subject of these terms and conditions.
“Eligible Lot” means a lot in which the Entrant resides, and in relation to which the Competition is entered into by the Entrant.
“Entrant” means an entrant in the Competition who has completed the registration process.
“Orana” means Orana by Balcon, the residential estate located in Clyde North, Victoria.
“Program Period” means the period commencing on 2 July 2026 and ending at on 18 October 2026, or such earlier time as Balcon determines at its discretion.
“Judging Criteria” means the criteria set out in clause 8 against which entries in the Competition will be assessed.
“Judging Panel” means the panel of judges appointed by Balcon to assess entries in the Competition.
By participating in the Competition, you agree to be bound by these Terms and Conditions. This Competition is governed by the laws of Australia and Victoria.
Who is conducting this Competition?
This Competition is conducted by Balcon, the developer of Orana. The Competition is conducted to promote Orana.
Eligibility
- In order to enter the Competition, you must:
- be a resident (owner-occupier or tenant) of an Eligible Lot in Orana, residing within the eligible stages as determined by Balcon – if requested by Balcon, provide proof of residency at the Eligible Lot;
- be 18 years of age or older at the date of entry;
- have a front garden that complies with Orana’s Design Guidelines;
- complete the online registration form during the Program Period, providing your name, address, stage/lot number, and contact details; and
- not be a director, employee, contractor, or immediate family member of Balcon, any member of the Judging Panel, or any entity involved in the administration or judging of the Competition.
- Entry into the Competition is limited to one entry per Eligible Lot.
- There is no fee to enter this Competition.
How to enter
- To enter the Competition, Entrants must:
- check that their property is within the eligible stages (as published on the Competition landing page at https://www.oranaclydenorth.com.au/front-garden-competition/);
- complete the online registration form at https://www.oranaclydenorth.com.au/front-garden-competition/ during the Program Period; and
- maintain their front garden in good condition through to the judging period in October 2026.
- By submitting the registration form, you confirm that you meet the eligibility requirements and agree to be bound by these Terms and Conditions.
Judging and determining the winners
- The Competition is a game of skill and entries will not be judged by chance.
- Judging will take place during October 2026. Members of the Judging Panel will assess front gardens based on areas visible from the street or publicly accessible areas only. Judges will not enter private or fenced areas of any Entrant’s property.
- Gardens will be assessed and scored by the Judging Panel based on the following criteria:
- Visual appeal: how well the garden looks overall, including design, colour coordination, and tidiness;
- Creativity: originality and artistic expression in the garden’s design;
- Sustainability: use of eco-friendly practices and low-maintenance plants;
- Plant health and maintenance: healthy plants and well-kept flower beds, shrubs, and trees; and
- Integration with home: how well the garden complements the house and enhances overall street appeal.
- You agree to accept the decisions of the Judging Panel and Balcon as final and binding. Any dispute in relation to the judging of the Competition will be determined by Balcon.
- Balcon reserves the right to disqualify any entry that it considers does not comply with these Terms and Conditions.
Prizes
Judges’ Awards
The following prizes will be awarded by the Judging Panel (“Judges’ Awards”):
- First Prize: one (1) Visa gift card valued at $2,500;
- Second Prize: one (1) Visa gift card valued at $1,500;
- Third Prize: one (1) Visa gift card valued at $500; and
- Top 20 Finalists: one (1) voucher to a local nursery partner valued at $50 per finalist.
People’s Choice Award
- A People’s Choice Award will be determined by community vote. The People’s Choice Award prize is one (1) Visa gift card valued at $500.
- The Top 20 Finalists (as determined by the Judging Panel based on the Judging Criteria) will be published via the MyOrana app and/or Instagram, and Orana residents will be invited to vote for the front garden they consider best satisfies the Judging Criteria.
- Voting for the People’s Choice Award will open following the announcement of the Top 20 Finalists in late October 2026 and will close in early November 2026 (exact dates to be published on the Competition landing page).
- Voting for the People’s Choice Award is limited to one vote per MyOrana account or household. Voting is open only to residents of Orana.
- The People’s Choice Award is a game of skill. Entrants’ prospects of winning the People’s Choice Award are to be determined by the quality of their front garden as assessed against the Judging Criteria. Only front gardens that have been assessed by the Judging Panel and shortlisted in the Top 20 Finalists on the basis of skill and merit are eligible for the People’s Choice Award.
- Voters will be invited to assess the Top 20 Finalist gardens against the Judging Criteria and vote for the garden they consider to be the most deserving. Each finalist garden will be presented MyOrana app and/or Instagram with a photograph of the front garden and a brief description to assist voters in making their assessment.
- The People’s Choice Award winner will be the front garden receiving the highest number of valid votes. In the event of a tie, Balcon will determine the winner (applying the Judging Criteria). This is a game of skill and chance plays no part in determining the winner.
- Balcon reserves the right to disqualify any vote it considers to be fraudulent, irregular, or otherwise not in compliance with these Terms and Conditions, and to discount such votes from the final tally.
Best Street Award
- A Best Street Award will be awarded to the street with the highest average garden score across all registered Entrants on that street during the October 2026 judging round.
- A street must have at least three (3) registered Entrants to qualify for the Best Street Award. For the avoidance of doubt, Entrants whose street does not meet this minimum threshold will not be eligible for the Best Street Award but remain eligible for all other prizes.
- The Best Street Award prize is a communal food truck event or neighbourhood picnic for the winning street (value up to $3,000), the form of which will be determined by Balcon. The Best Street Award prize is a communal event for the benefit of the winning street and may be enjoyed by all residents of that street, including non-Entrants but all Entrants acknowledge that Balcon will not determine whether any person accessing the Best Street Award prize is a resident of that street.
General Prize Conditions
- No cash or other prize substitution is permitted.
- All dollar figures referred to in these Terms and Conditions are in Australian dollars (AUD).
- Visa gift cards can only be used in accordance with their terms and conditions. Prize winners must satisfy themselves as to those terms and conditions, including any expiration dates or limitations on use. Balcon may provide single or multiple Visa gift cards to the value of the prizes shown above.
- Prizes are not transferable.
- All taxes which may be payable as a consequence of a prize winner receiving a prize are the sole responsibility of the prize winner.
- If a prize winner does not claim their prize within 30 days of being notified, the prize winner will be deemed to have forfeited the prize. In that event, Balcon may select an alternative winner or otherwise deal with the prize as it sees fit.
Winner Notification
- Winners of the Judges’ Awards, People’s Choice Award, and Best Street Award will be announced at the award ceremony in November 2026.
- Prize winners will also be notified in writing (via email or through the MyOrana platform) and the names of prize winners will be published on https://www.oranaclydenorth.com.au/front-garden-competition/, on Orana’s social media channels, and in the community newsletter.
- Prize winners must present identification acceptable to Balcon in order to claim their prize.
Consent to Photography and Publicity
- By entering the Competition, Entrants consent to Balcon (and its agents, contractors, and marketing partners):
- photographing and filming the Entrant’s front garden for the purposes of judging, publicity, and the People’s Choice voting gallery;
- publishing photographs of the Entrant’s front garden on the Competition landing page, MyOrana, Orana’s social media channels, community newsletters, and in media and public relations materials; and
- identifying prize winners by name and suburb in promotional and publicity materials.
- Entrants who are selected as Top 20 Finalists will be contacted to confirm their consent prior to their garden being published for the People’s Choice Award voting. If the Entrant does not provide consent within the time period for consent stipulated by Balcon, the Entrant is deemed to have withdrawn from entering the People’s Choice Award Competition.
- By entering the Competition, each Entrant grants to Balcon a non-exclusive, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, and distribute any content (including photographs, videos, and other materials) submitted by the Entrant in connection with the Competition, for the purposes of promoting the Competition, Orana, and Balcon’s business.
- Each Entrant warrants that any content submitted by the Entrant in connection with the Competition is the Entrant’s own original work and does not infringe the intellectual property rights or any other rights of any third party. The Entrant indemnifies Balcon and its related entities against any claim arising from a breach of this warranty.
Privacy Collection Statement
- Balcon will collect and use each Entrant’s personal information for the purposes of:
- conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition, including members of the Judging Panel) and for promotional purposes, public statements and advertisements in relation to the Competition;
- providing information to the Entrant about the products and services offered by Balcon and its related companies, including Orana; and
- research to improve Balcon’s products and services.
- By participating in the Competition, the Entrant consents to the use of their personal information as described in clause 35.
- Any personal data relating to the Entrant (including photographs of the Entrant’s property) will be used solely in accordance with current Australian data protection and privacy legislation, including the Privacy Act 1988 (Cth), and in accordance with Balcon’s privacy policy available at https://www.oranaclydenorth.com.au/front-garden-competition/ .
- Entrants may access, change, opt out and/or update their personal information in accordance with Balcon’s privacy policy.
- Balcon will only use the Entrant’s personal information for direct marketing purposes where the Entrant has provided express opt-in consent. Entrants may opt out of receiving marketing communications at any time by contacting Balcon or using the unsubscribe function in any marketing communication.
Limitation of Liability
- To the full extent permissible by law, Balcon (including Balcon’s related entities, employees, contractors, agents, and servants) is not liable to any Entrant or any other person for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising out of or in connection with participation in this Competition or receipt or use of any prize.
General Provisions
- This Competition cannot be used in conjunction with any other competition, offer or campaign promoted by Balcon, unless expressly stated otherwise.
- It is the responsibility of each Entrant to notify Balcon of any change to their contact details from those set out in the registration form.
- Failure by Balcon to enforce any of its rights under these Terms and Conditions does not constitute a waiver of those rights.
- Balcon reserves the right to vary the terms of, or cancel, the Competition at any time. Where Balcon makes a material variation to the Competition or cancels the Competition after registration has opened, Balcon will use reasonable endeavours to notify registered Entrants of such variation or cancellation in a timely manner via the Competition landing page, MyOrana, and/or email.
- If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
Social Media
- The Competition is in no way sponsored, administered, or associated with Instagram, Facebook, or any other social media platform.
Competition Timeline
- The key dates for the Competition are as follows:
- Registration opens: [insert date] July 2026;
